The judge’s verdict re-ignites the debate on the U.S. judiciary

Federal Judge Katherine Kimball Michel has challenged the government’s ruling that masks must be used on public transportation (such as airports and airports, buses and highways, trains, subways and their stations). Causes put forward by scientists at the Centers for Disease Control and Prevention (CDC). And she put forward her own reasons – which effectively guided her to define a public health policy for the whole country.

The decision angered the country’s liberal-democratic circles, who were dissatisfied with the power of the unelected Florida judge to formulate public policy for the entire country. Politicians, commentators and editorial experts have criticized the expansion of the judiciary in the United States, which is intertwined with representative democracy in the country.

Conservative-Republican circles celebrated the decision, apparently saying that the Liberals should live up to this new rule of law. To counter the joy of the Republicans, the liberal media must remember how and why Judge Katherine Kimball Michel, 35, was appointed to that position.

Former President Donald Trump nominated him – he is 33 years old – in late 2020, he had already lost the presidential election to Joe Biden. In the Senate hearing process, the American Bar Association (APA) classified him as “ineligible” for the position due to lack of experience.

He graduated from law school eight years ago and has never worked as a lawyer, lawyer or judge in a trial. He was still a coach in college and only participated in two trials as an assistant. In other words, zero experience in the courtroom.

However, he stood alone as a credible Conservative-Republican worker. He was an assistant to two conservative judges and Judge Clarence Thomas, considered the most conservative of the U.S. Supreme Court. She was affiliated with the Federalist Society, the conservative organization that nominates judges for Trump, and married Chad Michel, the attorney general for the Department of Homeland Security under the Trump administration.

He was a contract lawyer in Jones Dave who represented Trump in efforts to change the outcome of the 2020 election. It also led to a Republican majority in the Senate confirming their appointment before the newly elected senators take office in 2021. And transfer control of the House to the Democrats.

At its end Health Independence Care Fund v. பிடன், The judge stuck to a section of federal law that allows the CDC to force companies to clean and disinfect contagious contaminants. According to the judge, the law does not authorize the CDC to prevent contamination.

“Wearing a mask does not clean anything. At best, it catches drops of the virus. But it does not disinfect the person wearing the mask, nor does it disinfect the transport mechanisms,” he wrote. “The CDC has violated its legal authority and its order to wear the mask is arbitrary and capricious. It was also an impediment to the freedom of passengers.”

The Liberals, who were unhappy with the judge’s explanation that the law did not authorize the CDC to prevent pollution, cited an example: According to the judge, the CDC could not order the airline to keep its toilets free of sewage leaks to prevent passengers’ stress. Before cleaning and disinfecting the aircraft, he had to wait until the passenger sewer became contaminated.

Confusing results
Other lawsuits have been filed against the U.S. Department of Homeland Security CDC and the Traffic Safety Administration over government orders forcing the use of the mask on public transportation.

3 of them approached the Supreme Court and were dismissed. Others have been heard and rejected by federal appellate courts in the 4th, 8th, and 11th Regions, the District of Columbia and the Central District of Florida, in which the jurisdiction of the Federal Court is the first case in which Judge Katherine Michelle serves.

The difference is that all these courts have ruled in favor of an injunction restraining the mandatory use of the mask. Judge Katherine Mitchell ruled in favor of the legitimacy of the government order. The Health Independence Protection Fund and travelers Ana Dasa and Sarah Pope chose a convenient forum to file their case.

The U.S. Department of Justice may appeal the decision. But before that, the White House has decided that the CDC should conduct a study to confirm whether wearing a mask is still necessary on public transport. Otherwise, it is not worth going for. However, the number of Govit-19 cases has increased, especially in the Northeast region of the country, due to the PA2 sub variant of Omigran.
